Chapter 217
Article I
Parking on Private
Property
217-2. Manner of
parking restricted.
A. No bus, tractor,
trailer or any other vehicle, with the exception of a boat, shall be
parked in a courtyard or driveway in such a manner as to deprive an
adjoining property owner of light and/or air or diminish the quality of
light and air that said property would normally receive, but for the
presence of said bus, tractor, trailer or other vehicle.
B. Parking of a boat on
private property shall be permitted in the following areas under the
conditions defined:
1. One boat may
be parked in a driveway with the outermost portion of the boat being set
back three feet from the side yard, except in such situations where the
principal structure of the property is closer to the side yard than
three feet. Then and in that event the boat may be parked the same
distance from the side yard setback as the principal structure.
Regarding the front yard setback, the outermost portion of the boat may
not extend beyond the front yard setback into the City right-of-way.
2. An
alternative method of parking one boat may occur in a driveway with its
outermost extension adjacent to the side yard setback, on the condition
that the boat should be placed on a trailer. However, at no time shall
either the boat or the trailer extend beyond the front yard setback into
the City right-of-way.
4. Two boats
shall be permitted to be parked in a vacant lot, which vacant lot
adjoins property controlled by the owner of the boat that is to be
parked in said lot. The parking of the boat shall be subject to
compliance with all setback requirements as though the boat were a
structure.
217-3. Parking in
clear view prohibited.
The parking of any bus,
tractor, trailer, boat or any other vehicle shall be prohibited on any
front lawns, sidewalks or any other area of clear view, except proper
driveway parking unless contrary to 217-2 hereinbefore stated.
Article II
All-Night Parking
217-5. All-night
parking prohibited.
A. No person shall cause
or permit to be parked any camper; travel, vacation or house trailer;
vacation house; truck, half-ton or larger in size, which is commercially
registered; panel van; tractor; trailer; semitrailer; boat; jitney; bus;
or omnibus upon any public street, road or highway in the City of
Ventnor City between the hours of 9:00 pm and 6:00 am.
B. Parking of charter
buses shall be prohibited on any street, avenue or highway in the City
of Ventnor City. Additionally, charter buses shall be permitted to park
on Atlantic Avenue in the designated charter bus zone on the south side
of the 5500 Block to load and unload passengers only. Charter buses
shall also be permitted to load and unload passengers on private
property where such private property shall be deemed to be sufficient
for the safe operation of such charter buses. Such private properties
which are designated at this time include Shalom House, Beth Judah, St.
James, and the Ventnor Shopping Plaza. Nothing in this subsection shall
prohibit the owners of other properties form obtaining approval for
minibuses with seat capacities of less than 25 persons, provided that
there is sufficient room for such minibuses to park off the street to
load and unload. Any approvals related to this subsection shall be
obtained from the Chief of Police. All buses referenced in this
subsection shall have full authority and compliance with the Atlantic
County Transportation Authority.
Article III
Regulation of Parking on
Certain Streets
217-8. Parking sticker
required.
A. No person shall be
permitted to park any vehicle on the following describe streets or
portions thereof in the City of Ventnor City, unless such person has a
valid parking sticker:
1. Jackson
Avenue to Frankfort Avenue, between Beach Thoroughfare and the
Boardwalk, in the City of Ventnor City, New Jersey.
217-11. Exceptions.
Any person or persons who
shall be visiting residents of either owner-occupied facilities, or in
the alternative, residents with a lease for a period of 1 year who
reside in the district in which these parking stickers shall be
required, shall be permitted to park on a short-term basis for a period
not to exceed 2 hours on any one particular day and will not be required
to secure a parking sticker under the terms of this Article.
Article VI
Parking within Driveway
Areas
217-21. Statutory
Authority.
In accordance with NJSA
39:4-138d, no operator of a vehicle shall stand or park the vehicle in
front of a public or private driveway. The City of Ventnor City hereby
establishes that the width of a driveway within the City of Ventnor
City, whether public or private, where no parking shall be permitted
shall constitute the linear footage of width of the depressed curb of
the driveway, plus 36 inches beyond the depressed curb in each direction
along the curb line.
