Article II
Keeping of Cats and Dogs
105-12. Regulations
generally.
The following regulations
shall apply within the City of Ventnor City:
A. No dog or cat or any
animal shall be sheltered or kept that is not domesticated and permitted
by the State of New Jersey.
B. The quarters where
cats or dogs are kept shall be clean and sanitary and such as not to
create a health hazard or disturbances by reason of noise, odor or other
causes.
C. No person who owns,
keeps, harbors or maintains any cat or dog shall permit or suffer it to
do any damage to any person, fowl or domestic animal or permit or suffer
it to do any damage, to soil or defile any lawn, shrubbery, garden,
flowers, grounds or property other than that of the person owning,
keeping, harboring or maintaining such cat or dog.
D. Any person who shall
own, keep or harbor a dog in the City of Ventnor City shall:
1. Prevent such
dog from running at large upon any public street or public place,
including the Boardwalk and the beach, at any time.
2. Prevent such
dog from being on any public street or other public place at any time
unless such dog is accompanied by a person over the age of 9 years and
is securely controlled by an adequate leash not longer than 6 feet in
length.
3. Prevent such
dog from being on the Boardwalk, beach, the approaches thereto or on any
pier, pavilion, playground or recreational area of the City of Ventnor
City, whether the dog is leashed or unleashed, except that dogs on a
leash may be permitted on the beach only between October 1 and May 15 in
the area of the beach washed daily by the high tide.
4. Prevent such
dog from running at large upon the lands of any person, except the lands
of any person owning, keeping or harboring such dog, without the consent
of the owners of such lands.
5. Prevent such
dog from injuring or damaging any garden, flower garden, land, plant,
tree, shrubbery, grass, grounds or property of any person other than the
person owning, keeping or harboring such dog.
105-13. Curbing of
dogs.
Every person, whether he or
she is the owner or custodian of the dog, shall, when it is on the
public streets or sidewalks, curb said dog so as not to injure or damage
any garden, flower garden, land, plant, tree, shrubbery, grass, grounds
or other property of any person and under no circumstances shall allow
any dog to defecate or urinate upon any lawn, shrubbery or sidewalk.
Article IV
Nuisances
105-18. Prohibitions.
No person owning or in
charge of any dog shall cause or allow such dog to soil, defile,
defecate on or commit any nuisance on any common thoroughfare, sidewalk,
passageway, by-path, play area, park or any places where people
congregate or walk, or upon any public property whatsoever, or upon any
private property without the permission of the owner of said property.
105-19. Responsibility
of owner to remove feces.
Any person owning or in
charge of any dog which soils, defiles, defecates on or commits any
nuisance on any common thoroughfare, sidewalk, passageway, by-path, play
area, park or any place where people congregate or walk, or upon any
public property whatsoever, or upon any private property without the
permission of the owner of said property shall immediately remove all
feces deposited by any such dog by any sanitary method approved by the
local health authority.
105-20. Disposal of
feces.
The feces removed from the
aforementioned designated area shall be disposed of by the person owning
or in charge of any such dog in accordance with the provisions of this
article.
105-21. Exemptions.
The provisions of this
article shall not apply to blind persons who may use dogs as guides.
105-22. Disturbance of
peace and quiet prohibited.
No person shall harbor or
keep any dog within the boundaries of the city of Ventnor, New Jersey
that habitually barks so as to disturb the peace and quiet of the
persons residing in said City.
105-23. Methods and
ability to remove feces.
Any person owning or in
charge of any dog which defiles, defecates on or commits any nuisance on
any common thoroughfare, sidewalk, street, gutter, beach passageway,
bypath, play area, park, public school grounds, or upon any public
property whatsoever, or upon any private property without the permission
of the owner of said property, shall immediately remove feces deposited
by any such dog by any sanitary method approved by the Atlantic County
Health Department, State Department of Health, or method acceptable to
the local Code enforcement agency. Materials so removed shall be
disposed of by the person owning or in charge of any such dog through a
sanitary method such as through use of pooch scoops, small shovels or
plastic sealable bags. All such material shall be disposed of in a
sealed nonabsorbent, leak-proof container. Any owner or person in
charge of such dog being walked upon any common thoroughfare, sidewalk,
street, gutter, beach, passageway, bypath, play area, park, public
school grounds, or place where people congregate, must have in their
possession their cleanup device and nonabsorbent, leak proof container.
